Agreement for Inspection Service

Homes with Alarm Systems:

In areas where ADT offers inspection service, ADT will perform alarm system inspections for INSPECTOR's home buying clients free of charge. For each such inspection, ADT will provide a limited warranty, as described below.

INSPECTOR agrees to notify ADT, by fax or e-mail, of the scheduled inspection times for homes with alarm systems with as much advance notice as possible. INSPECTOR agrees that during the term of this Agreement, ADT will be the sole and exclusive company to provide inspections of alarm systems at those premises where INSPECTOR is engaged in providing its own services.

Homes Without Alarm Systems and Homes Where Inspection Service is not Available:

If the home to be inspected by INSPECTOR does not have an alarm system or the home is located in an area where ADT inspection service is not available, INSPECTOR will leave the designated ADT brochure at the home. For each such home, ADT will provide a limited warranty, as described below.

Limited Warranty:

In order to receive a limited warranty, INSPECTOR must provide ADT with the name, address and working phone number of the homebuyer, and must perform all of its obligations described above.

ADT will purchase a 90-day limited structural and mechanical warranty from Residential Warranty Services that will be provided to each of INSPECTOR's home buying clients described above. The effective date of the Warranty will be the date of the inspection. INSPECTOR has reviewed the Warranty terms. INSPECTOR will deliver the Warranty to the homebuyer.

ADT will not process the Warranty for homes with or without alarm systems if the homebuyer does not close on the home.

ADT will also not process the Warranty if the homebuyer's phone number is on a state or federal Do-Not-Call list, unless the home buyer provides a signed, written consent to the following statement, which must appear in the Inspection Agreement between INSPECTOR and homebuyer: "By signing this agreement you authorize ADT to call you, prior to you closing on the home, at the phone numbers you have provided to discuss a special alarm system offer."

Term:

The initial term of this Agreement shall be for one year from the date stated above. At the end of the initial term, this Agreement shall automatically continue until either party cancels the Agreement by giving thirty (30) days' advance written notice of such intention to the other party.
